With the new era of gay marriage being introduced... how does this effect a TS person?

Maybe I am over analyzing things, but how would that work out for us? Hypothetically speaking, would it still be a valid marraige?

I will use my boyfriend and I as an example. In the instance of gay marraige being legal, say we were to get engaged, and get married.

Would I marry as a male, or as a female? Say *heaven forbid* my husband died, and I need to file the life insurance. Now, they look in my past, and see I was formerly male, but married as female which nullifies the marraige. Now say I married as a male, but obviously all documents say I am female. Would this ALSO nullify the marraige?

I thought about that last night, and figured I would pose the question to y'all, and get some feedback!
